CLAUSE 45: REGULATIONS AND ORDERS
SUMMARY
1.
This clause makes provision in respect of the Commissioners’ powers
to make regulations and orders relating to aggregates levy.

OF THE CLAUSE

Subsection (1) provides for the negative procedure for regulations
made by statutory instrument.

Subsection (2) provides that, where a person fails to comply
with a relevant requirement imposed by regulations, they may provide
that he shall be liable to a penalty of £250.

Subsection (3) limits the aggregates penalty provisions where
someone is found guilty of any offence or is assessed to a civil penalty
under Schedule 6.
5.
Subsection (4) explains the term relevant requirement in subsection
(2) above as meaning all requirements other than those where specific
penalties have been provided for.
6.
Subsection (5) describes the ambit of the regulation and order
making powers.
7.
Subsection (6) excludes orders relating to commencement and
registration provisions from subsection (5) above.
