CLAUSE 21: OPERATORS OF SITES

SUMMARY

1.         This clause defines the person who is the operator of a site for the purposes of the levy.   

DETAILS OF THE CLAUSE

2.         Subsection (1) provides that the persons operating a site are each of the following:

(a) the person occupying the site; and

(b) any other person exercising a right to control aggregate on that site.

3.         Subsection (2) defines “exercising control” as:

(a) extracting aggregate from the land at that site;

(b) crushing rock at that site;

(c) carrying out an exempt process at that site;

(d) storing aggregate at that site.
