CLAUSE 20: ORIGINATING SITES


SUMMARY

1.         This clause defines the originating site of aggregate - referred to in Clause 19(2)(a)  


DETAILS OF THE CLAUSE

2.         Subsection (1) sets out four cases.  These are:

(a) for aggregate (other than rock) won from the seabed  of United Kingdom waters, the originating site is the point of first landing in the UK;

(b) for aggregate (other than rock) resulting from the application of an exempt process to any aggregate (as defined in clause 18 above), the originating site is the site where the exempt process was applied;

(c)  for rock, the originating site is the site where it is first crushed;

(d) in any other case, the originating site is the site where the aggregate was extracted (or most recently extracted).

3.         Subsection (2) provides that, in the case of any aggregate which is on its originating site on the commencement date and which has been mixed before that date with aggregate from another site, the site where the aggregate is situated on the commencement date shall be treated as the originating site for the whole of the aggregate as so mixed.
